RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT
By participating in the online shooting instruction provided by Daniel Horner, you acknowledge, understand, and agree to the following terms and conditions:
1. Voluntary Participation
By accessing and participating in the online shooting instruction, you acknowledge that your participation is entirely voluntary. You understand that firearms are inherently dangerous, and the use of firearms carries significant risks, including the risk of injury, death, or damage to property. Your decision to participate indicates that you fully accept these risks.
2. Assumption of Risk
You acknowledge and agree that by participating in the online shooting instruction, you assume full responsibility for any risks of injury or damage that may occur as a result of your participation. This includes any injury, death, or damage to property, whether caused by your actions, the actions of others, or the condition of any equipment or facilities used.
3. Release of Liability
By participating in the online shooting instruction, you agree to release, discharge, and hold harmless Daniel Horner, their agents, employees, contractors, owned and partnered companies, and affiliates from any and all claims, demands, causes of action, or liability of any kind whatsoever arising out of or related to your participation. This release includes liability for any injury, death, or damage to property that may occur, whether caused by negligence or otherwise.
4. Agreement to Follow Firearms Safety Rules
By participating in the online shooting instruction, you agree to adhere strictly to the following fundamental firearms safety rules at all times:
- Treat all firearms as if they are loaded.
You will always assume that every firearm is loaded, even if you believe it is not, and will handle it accordingly.
- Never point a firearm at anything you are not willing to destroy.
You will always keep the muzzle of the firearm pointed in a safe direction and never point it at another person or anything you do not intend to shoot.
- Keep your finger off the trigger until your sights are on the target and you have made the decision to shoot.
You will maintain trigger discipline at all times, ensuring your finger is outside the trigger guard until you are ready to fire.
- Be sure of your target and what is beyond it.
You will always positively identify your target and be aware of what lies beyond it to avoid unintended consequences.
5. Age Verification
By participating in the online shooting instruction, you represent and warrant that you are over the age of 18. You agree that you are legally permitted to handle firearms and participate in shooting activities under the laws of your jurisdiction. If you are not over the age of 18, you are not permitted to participate in this instruction, and you should discontinue your participation immediately.
6. Compliance with Laws
By participating in the online shooting instruction, you agree to comply with all applicable federal, state, and local laws regarding firearms and their usage. This includes but is not limited to the legal possession, transportation, and discharge of firearms. You understand that it is your responsibility to be aware of and adhere to the laws governing the use of firearms in your location, and you agree to take all necessary steps to ensure compliance with these laws. Failure to comply with any applicable laws may result in the termination of your participation in the instruction and may expose you to legal consequences.
7. Certification of Legal Status
By participating in the online shooting instruction, you certify that:
- You are not a fugitive from justice.
- You are not under indictment.
- You have not been convicted of a felony, misdemeanor, or any crime that would prohibit you from legally possessing or using firearms.
- You are not dependent on drugs or alcohol.
- You are not under adjudication of mental incompetence.
- You have not been convicted of any domestic violence offenses.
By making this certification, you confirm that you are legally permitted to participate in firearms-related activities and that you have not been disqualified from doing so by any legal or regulatory authority.
8. Acknowledgment of Agreement
By participating in the online shooting instruction, you acknowledge that you have read and understand this Release of Liability and Assumption of Risk Agreement. You agree that your participation serves as your acceptance of these terms and conditions and that you are giving up substantial rights, including your right to sue. You acknowledge that this agreement is binding and enforceable to the greatest extent allowed by law.
If you do not agree to these terms, discontinue your participation in the online shooting instruction immediately; your continued participation indicates your full acceptance and agreement to all the terms outlined above.
